The "Back2Labs, laboratoires solidaires" platform is an initiative of the Imabio GDR supported by Idylle. It aims to fluidify and accelerate the sharing capacity between academic laboratories members of the Imabio GDR.
This platform allows the development of announcements and their diffusion to members of the Imabio GDR for the exchange of goods or the provision of services related to the needs of laboratories.

Each of these announcements is framed via the rules presented below and are the responsibility of the Advertisers.

GENERAL RULES FOR THE DISTRIBUTION OF ANNOUNCEMENTS

This section contains all the rules that you must respect so that your announcement is referenced, and therefore published, on the platform whose purpose is to put several parties in contact with each other for the exchange of a good or the provision of a service.
Failure to comply with these rules is likely to result in the refusal of your announcement or its dereferencing, i.e. its removal from the platform.

GOOD PRACTICES
Here are some things to remember when placing an announcement:
. The text of the announcement must describe the product / good / service of the announcement. Announcements containing general text are not accepted. The text of the same ad must not offer more than one property.
. The announcement must be placed in a category corresponding to the subject of the announcement.
. You must indicate the deletion of an old announcement before inserting a new one relating to the same object. You cannot have the same announcement on the site several times simultaneously.
. We inform you that we authorize only one identical advertisement per applicant.
. All advertising announcements are prohibited.

Any advertisement inserted for the benefit of a professional making an offer of sale, services or intended to publicize his activity will be refused. The proposed announcements should only be in the context presented above, namely the exchange of goods or the provision of services related to the needs of laboratories.

GENERAL INTERDICTION
 Any advertisement containing text elements (words, expressions, sentences, etc.) which would appear to be contrary to legal or regulatory provisions, good morals, the rules of dissemination of our site or likely to disturb or shock readers will be refused, therefore no referenced on our site.

Unauthorized content
It is forbidden to place an ad:
- Containing terms or descriptions unrelated to the proposed content.
- Relying on information, data, images or content that are not free of rights.
- Directing directly or indirectly to a site other than that of GDR Imabio or that of Idylle.

Prohibition of products or services infringing intellectual property rights
Only the broadcasting of advertisements proposing the exchange of original products is authorized. You must be the legal owner of the content or be authorized to exchange it by its owner, its authorized agent or by law. It is authorized to insert photos with a watermark (digital tattoo) in order to ensure the protection of intellectual property rights. Only mentions of the owners of the photo in text form are accepted. These texts must be black or white. The insertion of website addresses on the photos remains strictly forbidden.

Unauthorized photographs
The photographs inserted must represent the good to be exchanged and cannot be used to illustrate several advertisements. It is forbidden to insert photographs with :
- Any recognizable person
- Logos only
- Link to a website
- Representations unrelated to the proposed Offer.

ADVERTISER'S OBLIGATIONS
The Advertiser guarantees that it holds all the rights (in particular intellectual property rights) or has obtained all the authorisations necessary for the publication of its Advertisement.
The Advertiser guarantees that the Advertisement does not contravene any regulations in force (in particular relating to advertising, competition, sales promotion, use of personal data, prohibition of the marketing of certain goods or services), nor any third party rights (in particular intellectual property rights and personality rights) and that it does not contain any defamatory or damaging message with regard to third parties.
Thus, the Advertiser undertakes in particular that the Advertisement shall not contain :
- no hypertext links redirecting Users to other Internet sites
- no information that is false, misleading or deceptive to Users of the platform
- no content infringing the intellectual property rights of third parties
- no content of a promotional or advertising nature related to the Advertiser's activity. Indeed, an Advertisement is intended to exchange a product or service and is not an advertising medium.

The Advertiser undertakes to offer in the Advertisements only available goods that he has. The Advertiser undertakes, in the event of unavailability of the good, to notify the site of the withdrawal of the Advertisement as soon as possible.
In this context, the Advertiser declares and acknowledges that it is solely responsible for the content of the Advertisements that it publishes and makes accessible to Users, as well as for any document or information that it transmits to Users.
The Advertiser assumes full editorial responsibility for the content of the Advertisements it publishes. Each Advertiser acknowledges and accepts that any Advertisement posted may be deleted or refused at any time.

In the event that these ads would give rise to an exchange of goods, it is agreed by users that the exchanges must follow the general rules set out below, which are not the responsibility of the platform.

GENERAL RULES GOVERNING EXCHANGES BETWEEN USERS OF THE PLATFORM

The Claimant undertakes to return the good or pay the corresponding sum to be specified by the user at the time when the good faith exchange between the parties is concluded. It is agreed that the Claimant shall be responsible for the outward (and return if necessary) transport of the goods. From the date of dispatch by registered mail, the goods shall be the responsibility of the Applicant, who shall arrange for their transport and security. The commitments and responsibilities of the parties shall end upon the return or reimbursement of the goods.
The Lender undertakes to be the holder of the property with right of use. If necessary, the Lender must ensure with whom it has the right to do so
- that he's entitled to the loan of the property.
- that this loan does not harm other users and to inform the director of his laboratory, service, platform, authority of this loan.
- that this property is acknowledged not to be subject to a valuation procedure by the parties (no valuation contract or possibility of valuation, commercial type equipment).

By definition, the ImaBio GdR, via its director and co-directors, is a trusted third party in the implementation of this loan. It is thus informed of all exchanges taking place on the platform.
If need be, the Lender can request that the Imabio GDR gives its support to the good conduct of the exchange and participates in the management of risks - technical or financial, or of dysfunction or deterioration of the equipment. In this case, the parties recognize the right of the Imabio GDR, through its directors, to appoint a committee of experts, in charge of proposing a solution. The parties then undertake to recognize and record the opinions rendered by this committee. The costs incurred by the Lender to ensure the reimbursement to the Lender of its property will be due by the Applicant to Lender ImaBio. The Applicant's laboratory undertakes to reimburse the said sums to the Lender.




La plateforme « Back2Labs, laboratoires solidaires » est une initiative du GDR Imabio soutenue par Idylle qui a pour but de fluidifier et d’accélérer la capacité d’échange entre laboratoires académiques membres du GDR Imabio.
Cette plateforme permet la mise au point des annonces et leur diffusion auprès des membres du GDR Imabio en vue de l’échange de biens ou la fourniture de services en lien avec les besoins des laboratoires.

Chacune de ces annonces est encadrée via les règles présentées ci-dessous et sont la responsabilité des Annonceurs.

REGLES GENERALES DE DIFFUSION DES ANNONCES

Cette rubrique contient l'ensemble des règles que vous devez respecter pour que votre annonce soit référencée, donc diffusée, sur la plateforme qui a pour objet la mise en relation de plusieurs parties en vue de l’échange d'un bien ou de la fourniture d'un service.
Le non-respect de ces règles est susceptible d'entraîner le refus de votre annonce ou son déréférencement, c'est-à-dire sa suppression de la plateforme.

BONNES PRATIQUES
Voici quelques points à retenir lorsque vous déposez une annonce :
- Le texte de l'annonce doit impérativement décrire le produit/bien/service de l'annonce. Les annonces contenant un texte généraliste ne sont pas acceptées. Le texte d’une même annonce ne doit pas proposer plusieurs biens.
- L’annonce doit être déposée dans une catégorie correspondant à l’objet de l’annonce.
- Vous devez indiquer la suppression d’une annonce ancienne avant d'en insérer une nouvelle relative au même bien. Vous ne pouvez en effet avoir simultanément plusieurs fois la même annonce sur le site.
- Nous vous informons que nous autorisons une seule annonce identique par demandeur.
- Toute annonce à caractère publicitaire est interdite.

Toute annonce insérée au profit d'un professionnel faisant une offre de vente, de services ou destinée à faire connaître son activité sera refusée. Les annonces proposées ne devront l’être que dans le contexte présenté ci-dessus à savoir de l’échange de biens ou la fourniture de services en lien avec les besoins des laboratoires.

INTERDICTIONS GÉNÉRALES
Toute annonce contenant des éléments de texte (mots, expressions, phrases… etc.) qui sembleraient contraires aux dispositions légales ou réglementaires, aux bonnes mœurs, aux règles de diffusion de notre site ou susceptible de troubler ou choquer les lecteurs sera refusée, donc non référencée sur notre site.

Contenus non autorisés
Il est interdit de déposer une annonce :
- Comportant des termes ou des descriptions sans lien avec le contenu proposé.
- S’appuyant sur des informations, des données, des images ou contenus qui ne sont pas libres de droit.
- Dirigeant directement ou indirectement vers un site autre que celui du GDR Imabio ou celui d’Idylle.

Interdiction des produits ou services portant atteinte aux droits de propriété intellectuelle
Seule la diffusion d'annonce proposant l’échange de produits originaux est autorisée. Vous devez être légalement propriétaire du contenu ou être autorisé à l’échanger par son propriétaire, par son mandataire agréé ou par la loi. Il est autorisé d’insérer des photos comportant un watermark (tatouage numérique) dans le but d'assurer la protection des droits de propriété intellectuelle. Seules les mentions des propriétaires de la photo sous forme de texte sont acceptées. Ces textes doivent obligatoirement être de couleur noire ou blanche. L’insertion d’adresse de site internet sur les photos reste strictement interdite.

Photographies non autorisées
Les photographies insérées doivent représenter le bien à échanger et ne peuvent être utilisées pour illustrer plusieurs annonces. Il est interdit d’insérer des photos comportant :
- Toute personne reconnaissable
- Logos seuls
- Lien vers un site internet
- Représentations sans lien avec l’offre proposée.

OBLIGATIONS DE L’ANNONCEUR
L'Annonceur garantit détenir tous les droits (notamment des droits de propriété intellectuelle) ou avoir obtenu toutes les autorisations nécessaires à la publication de son Annonce.
L'Annonceur garantit que l'Annonce ne contrevient à aucune réglementation en vigueur (notamment relatives à la publicité, à la concurrence, à la promotion des ventes, à l'utilisation de données personnelles, à la prohibition de la commercialisation de certains biens ou services), ni aucun droit de tiers (notamment aux droits de propriété intellectuelle et aux droits de la personnalité) et qu'il ne comporte aucun message diffamatoire ou dommageable à l'égard de tiers.
Ainsi, l'Annonceur s'engage notamment à ce que l'Annonce ne contienne :
- aucun lien hypertexte redirigeant les Utilisateurs notamment vers des sites internet
- aucune information fausse, mensongère ou de nature à induire en erreur les Utilisateurs de la plateforme
- aucun contenu portant atteinte aux droits de propriété intellectuelle de tiers
- aucun contenu à caractère promotionnel ou publicitaire en lien avec l'activité de l'Annonceur. En effet, une Annonce est destinée à échanger un produit ou un service et n'est pas un support de publicité.

L'Annonceur s'engage à ne proposer dans les Annonces que des biens disponibles dont il dispose. L'Annonceur s'engage, en cas d'indisponibilité du bien, à signifier au site le retrait de l'Annonce dans les plus brefs délais.
Dans ce cadre, l'Annonceur déclare et reconnaît qu'il est seul responsable du contenu des Annonces qu'il publie et rend accessibles aux Utilisateurs, ainsi que de tout document ou information qu'il transmet aux Utilisateurs.
L'Annonceur assume l'entière responsabilité éditoriale du contenu des Annonces qu'il publie. Chaque Annonceur reconnaît et accepte que puisse être supprimées, ou refusées, à tout moment, toute annonce déposée.

Dans le cas où ces annonces donneraient lieu à un échange de bien, il est convenu par les utilisateurs que les échanges devront suivre les règles générales édictées ci-dessous qui ne sont pas la responsabilité de la plateforme.

RÈGLES GÉNÉRALES ENCADRANT LES ÉCHANGES ENTRE UTILISATEURS DE LA PLATEFORME

Le Demandeur s’engage à restituer le bien ou payer la somme correspondante qui sera précisée par l’utilisateur au moment où sera conclu l’échange de bonne foi entre les parties. Il est convenu que le Demandeur prendra à sa charge le transport aller (et retour si nécessaire), du bien. A compter de la date d’envoi réalisé par recommandé, le bien est sous la responsabilité du Demandeur qui doit prendre les dispositions pour en assurer le transport et la sécurité. Les engagements et les responsabilités des parties prendront fin à compter du retour ou du remboursement du bien.
Le Prêteur s’engage à être le détenteur du bien avec droit de jouissance. S’il y a lieu le Prêteur doit s’assurer auprès de qui de droit :
- qu’il est fondé à faire le prêt du bien.
- que ce prêt ne porte pas tort à d’autres utilisateurs et de prévenir de ce prêt le directeur de son laboratoire, service, plateforme ou son autorité compétente.
- que ce bien est reconnu ne pas faire l’objet de procédure de valorisation par les parties (absence de contrat de valorisation ou de possibilité de valorisation, matériel de type commercial).`
Par définition le le GdR ImaBio, via son directeur et ses co-directeurs, se porte tiers de confiance dans la réalisation de ce prêt. Il est ainsi informé de tous les échanges ayant lieu sur la plateforme.
Si besoin, le Prêteur peut faire la demande que le GDR Imabio apporte son soutien à la bonne conduite de l’échange et participe à la gestion des risques - techniques ou financiers, ou encore de dysfonctionnement ou détérioration du matériel. Dans le cas, les parties reconnaissent au GdR Imabio, au travers de ses directeurs, le droit de nommer un comité d’experts, chargé de proposer une solution. Les parties s’engagent alors à reconnaître et acter les avis rendus par ce comité. Les frais engagés par le GdR ImaBio pour assurer le remboursement au Prêteur de son bien seront dus par le Demandeur au GdR ImaBio. Le laboratoire du Demandeur s’engage alors à rembourser lesdites sommes au GdR.
